Terms of service
Effective for current ConditionRail workspaces.
1. What ConditionRail does
ConditionRail prepares and routes mortgage file work. The product organizes conditions, requests documents from borrowers, classifies and verifies returned evidence, syncs status with connected Loan Origination Systems, and assembles underwriter-ready packets with a complete action log.
2. Decision responsibility stays with the customer
Lender, broker, and credit-union customers retain sole responsibility for credit decisions, underwriting, regulatory compliance, adverse action notices, fair lending program execution, and any commitment made to a borrower. ConditionRail does not underwrite loans, does not issue credit decisions, and does not communicate decisions to borrowers on a customer's behalf.
AI may classify, match, draft, and flag. It may not approve, deny, waive, or communicate a credit decision.
3. No legal or financial advice
Product copy, templates, condition libraries, and reminders are operational tooling. They are not legal advice, financial advice, accounting advice, or a substitute for a customer's own qualified counsel and compliance program.
4. Authorized use only
Workspaces are licensed to a named customer and may be used only by authorized personnel acting on behalf of that customer for legitimate mortgage file work. Customers are responsible for managing seat assignments, removing departed staff, and preventing unauthorized access.
5. Integration credentials and LOS permissions
The customer is responsible for the accuracy, scope, and lawful issuance of all credentials provided to ConditionRail, including LOS user accounts, API tokens, document service credentials, and messaging accounts. The customer is responsible for ensuring that connected LOS users have appropriate permissions and that those permissions reflect the customer's compliance program.
6. Acceptable use
Use of ConditionRail is subject to the Acceptable Use policy. The customer is responsible for the conduct of its workspace users.
7. Service availability and changes
ConditionRail may update features, integrations, and operational defaults to improve reliability and security. Material changes to data handling defaults will be communicated to workspace administrators in advance.
8. Termination
Customers may end a workspace at any time. On termination, customer data is exported on request and removed under the retention schedule described in the Privacy policy.
